Will existing Skilled Workers face a ten-year settlement wait?

Alex (fictional example) 1 h ago

Editorial discussion prompt using a fictional name; this is not a real visitor’s case.

Following the earned-settlement announcement on 2 November 2026, how would the ten-year baseline affect someone already in the UK on a Skilled Worker visa who expected to qualify after five years? What transitional provisions and commencement dates should they check before making plans?

Source: Hansard, “Immigration: Earned Settlement”, Home Secretary’s statement, 2 November 2026. This is an announced policy: rule changes are expected to begin to be laid in December, with implementation during 2027. Do not assume eligibility changes immediately.

Yes—some existing Skilled Worker visa holders could face a longer wait under the policy announced on 2 November 2026. However, it does not mean every existing worker automatically moves to ten years today. The announcement retains shorter pathways for qualifying earners and specified public-service workers, alongside targeted transitional arrangements.

The Home Secretary said rule changes would begin to be laid in December, with implementation during 2027. The operative Rules, commencement provisions and any transitional protection must therefore be checked before deciding an individual’s eligibility. Arrival on a five-year route should not be treated as a guarantee that those requirements can never change.

Keep your immigration permission valid and retain your immigration, employment, earnings and absence records. Do not delay or submit a settlement application solely because of a headline; obtain an assessment against the rules applicable to your circumstances.
